Reversing the circuit court’s denial of the defendant’s motion to dismiss for lack of jurisdiction, holding that because an automobile cannot be “carried” or “concealed on or about one’s person,” the youth court has exclusive jurisdiction over a juvenile offender who commits a felony using an automobile.

CONTEXT – The youth court has exclusive original jurisdiction in all proceedings concerning a delinquent child, subject to some exceptions. One exception applies when a child commits a felony with a deadly weapon that is illegal, under section 97-37-1, to carry in a concealed manner. The defendant was seventeen when he allegedly drove his car intentionally into a car carrying his mother, siblings, and step father. The defendant was indicted for four counts of aggravated assault. He filed a motion to dismiss the indictment, arguing that the youth court had exclusive jurisdiction. The circuit court denied the motion.
